Arkansas stopped enforcing Act 630 governing drug distribution after a federal court found the measure likely unconstitutional. Following the court decision, the Arkansas State Board of Pharmacy suspended enforcement of the 2025 law that required inclusion of in-state pharmacies in limited distribution networks held longer than three months. The board cited the constitutional concern around unduly restricting interstate commerce and noted the Arkansas Attorney General’s assessment that the law could not be defended successfully in future litigation. The law also carried steep daily penalties and risked Medicaid coverage loss for noncompliant manufacturers. Industry groups raised additional patient-safety concerns, especially for therapies with FDA-required REMS or special handling protocols that depend on controlled distribution pathways. BIO officials said complex therapies make safe distribution more sensitive to network design.
